The aftermath of wildfires can be overwhelming—not only for those directly affected but also for real estate professionals who aim to guide them through the process of recovery. In California, where wildfires are unfortunately all too common, REALTORS® play an essential role in helping homeowners, renters, and communities bounce back. The California Association of Realtors® (C.A.R.) has been actively supporting displaced individuals and families by sharing crucial insights on financial assistance, insurance claims, and safeguards to protect from exploitation during this challenging time.
If you’re an agent in an area affected by wildfires, you’re in a unique position to be a resource for your clients. Here’s a closer look at what you can do to support those impacted by wildfires, along with helpful resources from C.A.R. to keep you informed and ready to assist.
Immediate Financial Assistance for Homeowners
One of the first steps for homeowners affected by wildfires is applying for financial assistance. C.A.R. encourages REALTORS® to guide their clients through the process of accessing both FEMA (Federal Emergency Management Agency) assistance and insurance claims.
FEMA Assistance: Individuals impacted by wildfires can apply for federal assistance via DisasterAssistance.gov or through the FEMA mobile app. FEMA provides financial support for temporary housing, home repairs, and personal property loss. FEMA will also offer transitional sheltering assistance, meaning temporary hotel stays for eligible individuals. While FEMA aid cannot duplicate insurance coverage, it’s important for REALTORS® to remind clients to file claims with their insurance companies immediately to maximize their recovery.
Insurance Claims Process: The insurance claim process is often the most crucial step in recovery, and as agents, you can help clients navigate it. After filing a claim, an adjuster will assess the property’s damage. As C.A.R. highlights, be cautious of “quick settlements” that insurance companies may offer, as these may not reflect the full extent of the loss. Encourage your clients to thoroughly document their losses and request a detailed estimate.
For a more in-depth understanding of how insurance payments work, C.A.R. recommends checking out the California Department of Insurance’s “Residential Property Claims Guide”. It’s an excellent resource for both agents and homeowners, ensuring they understand their rights and the claims process.
Protecting Homeowners from Price Gouging and Exploitation
Sadly, in the aftermath of disasters, some bad actors attempt to exploit vulnerable people. REALTORS® can be instrumental in ensuring that clients are aware of their rights and protections under California law.
Rental Price Gouging: After the declaration of an emergency, California law prohibits landlords from increasing rents by more than 10% for affected residents. This protection applies to both new and existing tenancies. REALTORS® should make clients aware of these restrictions, which remain in effect until March 8, 2025 (or possibly longer). Penalties for violating these rules can include up to a $10,000 fine and even jail time. If you spot rental gouging or unfair practices, report them to the State Attorney General’s office at oag.ca.gov/report.
Safeguards Against Opportunistic Speculators: Another unfortunate byproduct of natural disasters is the rise of predatory speculators seeking to buy homes well below market value. Governor Gavin Newsom issued an Executive Order to protect homeowners from these opportunistic investors. This order makes unsolicited cash offers for fire-affected homes illegal until January 7, 2026. As a REALTOR®, you can ensure your clients know that they should never feel pressured to accept offers far below market value.
How You Can Help
As REALTORS®, you’re not only helping clients find homes but also assisting them through some of the toughest moments of their lives. You can make a difference by offering guidance on:
- FEMA Assistance and Insurance Claims: Be a trusted resource by pointing clients toward the right resources and ensuring they don’t miss critical deadlines or benefits.
- Protecting Against Price Gouging: Keep clients informed about rent control laws and their rights to fair housing during the emergency period.
- Beware of Scams: Help homeowners stay vigilant against opportunistic investors and others seeking to take advantage of their situation.
Wrapping Up
In times of crisis, REALTORS® are often the first line of defense for those affected by disasters. Whether it’s helping clients with insurance claims, offering guidance on rental protections, or simply being a compassionate listener, you’re an invaluable part of their recovery journey. By staying informed and sharing the right resources, you can make sure your clients are protected from fraud and unfair practices while getting the help they need to rebuild.
